Conditions of Use for ClipCloud Image Generation Service

1. basic information:

1.1. The Administration is not liable for any actions taken by users or the consequences thereof, including, but not limited to:

1.1.1. That violate the laws of the Russian Federation, the Republic of Kazakhstan, Georgia, the Republic of Belarus, as well as the country where the user resides and/or is located.

1.1.2. Those that infringe on the rights of third parties.

1.1.3. Violations of these Terms of Service.

1.1.4. Violators image generation rules.

1.2. The Administration is not liable for any lost profits or any other losses arising from the use or non-use of this service.

1.3. This service includes a system for automatically detecting and blocking requests that violate the rules. However, due to the nature of neural networks and automated verification systems, the user agrees to independently verify that both requests and the resulting images comply with the rules, applicable laws, and copyright regulations. By accepting these rules and launching the service, the user acknowledges that the administration does not manually review images due to the technical impossibility of doing so, and that automated verification systems, due to the nature of their operation, may produce both false positives and false negatives.

1.4. By accepting these Terms of Use, the user agrees that:

1.4.1. The administration has taken all reasonable organizational and technical measures to ensure the security of the artificial intelligence model;

1.4.2. The administration has taken comprehensive measures to prevent the acquisition of items prohibited by these rules, as well as image generation rules, and/or an unlawful result, as well as to compliance with legal requirements when providing access to the artificial intelligence service.

2. User:

2.1 Before registering in the service, he/she is obliged to familiarize himself/herself with the rules of its use, as well as to image generation rules. If the user has not familiarized or does not agree with the rules in part or in full, such user has no right to use this service for any purpose.

2.2. undertakes to comply fully with the following image generation rules, and to ensure compliance with these rules by independently verifying that requests and the resulting images adhere to the rules.

2.3 Confirms that he/she is a fully capable person who has reached the age of 18 years.

2.4 The user is obliged not to try to bypass any protection and security systems of this service. If the user has managed to bypass any protection system, including automated checking of requests for compliance with the rules, the user undertakes to notify the administration about it to the contacts specified in the service.

2.5. undertakes not to generate content, not to use requests, as well as not to enter in the bot information containing any personal data of the User and/or third parties; data constituting state, banking, tax, commercial, medical and other secrets protected by law.

2.6 Independently liable to third parties for their actions and their consequences related to the use of the service, including in cases where such actions will lead to the violation of the rights and legitimate interests of third parties, as well as for compliance with the law when using the service.

3. Administration:

3.1 It does not own the copyright to user-generated images, and does not make any claims to them.

3.2 Due to the peculiarities of neural networks operation, is not responsible for the results of image generation, consequences of any actions with them, as well as possible losses.

3.3 In case of systematic and/or intentional violation of the rules specified on this page, the manufacturer of this product (administration) may apply any or several of the following actions:

3.3.1 Send a warning against violation of the rules.

3.3.2 Disable the possibility of further replenishment of the balance by the user.

3.3.3 Cancel the user's account in the service, prohibiting further use of the service by such user.

3.4 The Administration undertakes to return to the buyer the money paid for the use of this service, with simultaneous cancelation of the units of paid computing time if all of the following conditions are met at the same time:

3.4.1. the User contacted the technical support at the contacts specified in the service with a request for a refund;

3.4.2 The user's request has been completed no later than 3 calendar days (72 hours) after the user has paid for the computing time units;

3.4.3. The user has provided a wallet or card number for the refund, their account ID (identification number)—which the user can find on the ClipCloud personal account page—as well as the payment ID, if one was provided to the user;

3.4.4 The wallet or card number for refunds provided by the user fully coincides with the wallet or card number from which the user made the payment;

3.4.5 The user has not violated the rules of use while using the software.

3.4.6 The User has not used up the number of units of computing time that they have paid for. In the event that a part of the units of computing time has been used up, the administration may in some cases consider refunding at its discretion either the full amount or a part of the amount that corresponds to the unused part of the units of computing time.

3.5 Administration is not responsible for possible problems and/or defects in third-party software, which added the ability to use this service.

4. payment:

4.1 All countries except: Iran, North Korea, Cuba, Libya, Syria, Somalia, Sudan, Eritrea are available for payment for this service and/or delivery of its results. The User confirms that at the time of purchase and any fact of use of this service is not located in any of these countries, as well as does not use data for payment or currency of these countries when paying for the service.

4.2. Users may be able to use the service for free. Information regarding this option, as well as any additional rules governing such use, is provided in the relevant section of the service’s user account.

4.3. When adding funds to the service, the user can purchase units of computing time, which are referred to in the service as “Images,” “Pictures,” or “🖼️.” The user understands that one unit of computing time does not always equal one generated image and may be either more or less, depending on the parameters set by the user or the image generation style they select. The user can check the cost of generating an image with specific parameters before using computing time units (with the exception of software whose developers have integrated this service’s API but do not use the feature to display the cost of image generation). To do this, the user can go to “Settings” from the main menu and click the corresponding menu button so that it displays “✅ Show generation cost.” You can also find out the approximate cost of images in each style on the corresponding page.
